How to use Annexure A
Attach Annexure A to your agency's standard listing agreement and have the seller sign it.
It isn't a legal requirement. Your standard listing agreement is enough to sell with Openn Offers. Annexure A is extra protection that puts the seller's instructions in writing, including that:
- the property is being sold through Openn Offers, which is not an auction
- only offers from Qualified Buyers will be passed on
- you can reveal that an offer has been made and, where the law allows, the offer price (clause 2.10)
Annexure A links to the Openn Offers Terms of Use, so there's nothing else to print or attach. Buyers accept the Terms of Use when they place an offer.
Revealing offers
- South Australia: offer prices can't be revealed, but you can still show offer ranking. Clause 2.10 only allows the price to be shown where the law permits it.
- New Zealand: offer details are confidential unless the seller consents in writing (Rule 9.17(a) of the Real Estate Agents Act (Professional Conduct and Client Care) Rules 2012). Clause 2.10 gives that consent. A Multiple Offer Form isn't required, as long as you reveal the number of offers through Openn as soon as there's more than one.
- Other states and territories: choose what buyers can see when you upload the listing. See Price transparency with Openn Offers.
